1. Acceptance of Terms

Welcome to Pamusika! By accessing or using the Pamusika mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Pamusika ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Pamusika is an agricultural marketplace platform that connects farmers, producers, and agricultural sellers ("Sellers") with buyers ("Buyers") in Zimbabwe and the surrounding region. Our Service includes:

• A mobile application for listing and browsing agricultural products
• In-app messaging between Buyers and Sellers
• An AI-powered assistant ("Mupfuyi") for search and support
• Location-based discovery of nearby products and sellers
• Reviews and ratings system

Important: Pamusika is a marketplace platform that facilitates connections between Buyers and Sellers. We are not a party to transactions between users and do not guarantee the quality, safety, or legality of items listed.

3. Eligibility

To use Pamusika, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

4. User Accounts

4.1 Account Creation

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our discretion.

5. Seller Terms

If you list products on Pamusika, you agree to:

• Provide accurate descriptions, photos, and pricing for your products
• Only list products you have the legal right to sell
• Comply with all applicable laws regarding food safety, agriculture, and commerce
• Respond to buyer inquiries in a timely manner
• Honor agreed-upon prices and terms with buyers
• Not engage in price manipulation or deceptive practices

5.1 Prohibited Items

You may not list:

• Illegal or controlled substances
• Stolen or counterfeit goods
• Products that infringe on intellectual property rights
• Hazardous or unsafe items
• Any non-agricultural products without prior approval

6. Buyer Terms

If you purchase products through Pamusika, you agree to:

• Provide accurate contact and delivery information
• Complete transactions in good faith
• Inspect products upon receipt and report issues promptly
• Communicate respectfully with sellers
• Pay agreed-upon prices and not engage in fraudulent chargebacks

7. Transactions & Payments

Pamusika facilitates connections between Buyers and Sellers but is not responsible for the actual transactions between parties. Users are responsible for:

• Agreeing on payment terms and methods
• Arranging delivery or pickup
• Resolving disputes directly when possible

We recommend using secure payment methods and meeting in safe, public locations for transactions when possible.

8. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Harass, threaten, or abuse other users
• Post false, misleading, or defamatory content
• Attempt to circumvent platform fees or security measures
• Use automated systems to access the Service without permission
• Interfere with the proper functioning of the Service
• Collect user information without consent
• Use the platform for spam or unauthorized advertising

9. AI Assistant (Mupfuyi)

Our AI-powered assistant, Mupfuyi, is provided to help you search for products, get information, and navigate the platform. By using Mupfuyi, you understand that:

• AI responses are generated automatically and may not always be accurate
• Mupfuyi does not provide professional agricultural, legal, or financial advice
• Your interactions with Mupfuyi may be logged for service improvement
• You should verify important information independently

10. Intellectual Property

10.1 Our Property

The Pamusika name, logo, app design, and all related trademarks, copyrights, and intellectual property are owned by us. You may not use our branding without written permission.

10.2 Your Content

You retain ownership of content you post (listings, photos, reviews). By posting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Service.

12. Limitation of Liability

To the maximum extent permitted by law, Pamusika shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising from your use of the Service or transactions with other users.

13. Indemnification

You agree to indemnify and hold harmless Pamusika, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Dispute Resolution

For disputes between users, we encourage direct communication and resolution. Pamusika may, at its discretion, assist in mediating disputes but is not obligated to do so.

For disputes with Pamusika, these Terms shall be governed by the laws of Zimbabwe. Any legal proceedings shall be conducted in the courts of Zimbabwe.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
